This course is ideal for Child Care Lawyers wishing to gain confidence in dealing with contested cases

This course will help you to:

The workshop uses a case study and every student is given the opportunity to practice their own advocacy skills and learn from the experience of others.

  • Gain confidence in conducting contested hearings
  • Understand the purpose of a good “opening”
  • Assist your witness to give clear evidence in chief
  • Identify the aims of cross examination
  • Deal with the expert witness

The programme for the day will include:

Morning

  • The purpose and presentation of an opening note
  • The drafting of the Threshold Criteria
  • The calling of live witnesses
  • Dealing with robing room negotiation (or bullying)
  • The impact of a judicial “indication”
  • How to deal with evidence-in-chief

Afternoon – Cross-examination

  • Objectives of cross-examination
  • It’s limits
  • The questions
  • Tactical considerations
  • The cross-examination of experts
  • Case study plus your chance to practice in a friendly environment!
