Prosecutions under the Smoke Free Legislation

From the 1st July 2007 the Health Act 2006 required all premises used by the public including workplaces to be smoke free. This course follows a recent successful contested prosecution brought by Bradford Council the first in West Yorkshire and is ideal for Environmental Health officers and Council lawyers.

The course will help you to:

  • Understand the background to the smoke free legislation
  • Explore the new statutory defences to the offences under sections 6 and 8 of the Health Act 2006
  • See an actual  case from beginning to end

The day will cover in detail:

  • Sections 6 , 7 and 8 of the Health Act 2006
  • How to obtain sufficient evidence required to present a case to the court.
  • The statutory framework for investigation including including an overview of MCA 1980, CJA 1967, PACE 1984, CPIA 1996, RIPA 2000 and the CJA 2003.
  • New Code of Practice for Regulators 2006.
  • The case in court and the statutory defences explained.
  • Next steps following conviction –from the complaint to proactive enforcement of the smoke free legislation – a work shop.
